AF Noonan (Architectural Practice) Ltd –v- Bournemouth & Boscombe Athletic Community Football Club [2006] All ER (D) 169 has now been given permission to appeal.
The Appeal is due to be heard on 1st March 2007. The case is concerned with the effect of CPR 39.2 where the court makes an order that a hearing be held in private. The main issue arising is whether disclosure of the matters subject to the hearing amounts to a contempt of court or whether the court needs to make another order under section 12 of the Administration of Justice Act 1960 or otherwise in order to make disclosure or contempt.
